Terms of Service

1. Acceptance of Terms

By accessing and using the website and services of Lead4u LLC ("LEAD4U", "we", "us"), you accept and agree to be bound by these Terms. Our Acceptable Use Policy, Messaging & SMS Policy, and Privacy Policy are incorporated into these Terms by reference.

2. Description of Service

LEAD4U provides:

  • Communications services — consent-based customer messaging and voice workflows (appointment reminders, confirmations, status updates, review requests, follow-ups, two-way replies, and inbound call handling), including A2P 10DLC brand and campaign registration where applicable
  • Marketing services — Search Engine Optimization (SEO), Pay-Per-Click (PPC) advertising, social media marketing, local listings management, brand building, and web development

3. Service Terms and Pricing

Representative marketing-service pricing includes SEO from $499/month, PPC management from $999/month, and listings management from $99/month; communications-service pricing is quoted per engagement. Pricing is subject to change with 30 days written notice. Custom packages are available upon consultation.

4. Client Responsibilities

Clients are responsible for:

  • Providing accurate and timely information
  • Making timely payments according to agreed terms
  • Providing necessary access to accounts and platforms
  • Reviewing and approving campaigns before launch
  • Obtaining and documenting all consents required by law before any message or call is sent, and honoring opt-out requests
  • Complying with all applicable laws and regulations and with our Acceptable Use Policy and Messaging & SMS Policy

5. Acceptable Use & Anti-Spam

You will not use our services to send unsolicited bulk messages, calls, or email, to message or call anyone without the consent required by law (including the TCPA and the CAN-SPAM Act), or to send any content prohibited by our Acceptable Use Policy or Messaging & SMS Policy. You are responsible for obtaining and documenting all required consents and for honoring opt-out requests (STOP/UNSUBSCRIBE) in real time. You will not spoof sender IDs or caller ID, use grey routes, or engage in traffic pumping or artificial inflation of traffic. If we permit you to provide communications services to your own customers, you must verify their identity and use case, register campaigns as required, bind them to terms at least as protective as our AUP, and remain responsible for their traffic. We may suspend or terminate services for violations and pass through any resulting carrier fees, fines, or chargebacks.

6. Payment Terms

  • Monthly services are billed in advance
  • Payment is due within 15 days of invoice date
  • Late payments may incur additional fees
  • Services may be suspended for non-payment
  • Refunds are subject to individual service agreements

7. Service Guarantees and Limitations

While we strive for excellent results, marketing and communications involve variables beyond our control (search algorithms, carrier filtering, recipient behavior). We do not guarantee specific outcomes such as particular search rankings, exact return on investment, specific lead or message-volume numbers, or immediate results; most marketing campaigns require several months to compound.

8. Intellectual Property

Materials created by LEAD4U remain our intellectual property until final payment is received. Upon full payment, clients receive usage rights for materials specifically created for their campaigns.

9. Confidentiality

We maintain confidentiality regarding client information, strategies, and data, and expect the same regarding our methodologies and proprietary processes.

10. Contract Termination

Either party may terminate services with 30 days written notice. Upon termination: the client is responsible for payment of services rendered; access credentials are transferred back to the client; final reporting is provided; and ongoing campaigns are paused or transferred as requested.

11. Limitation of Liability

Lead4u LLC's liability is limited to the amount paid for services in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.

12. Dispute Resolution

Any disputes will be resolved through mediation in Dallas, Texas. If mediation fails, disputes will be resolved through binding arbitration under Texas state law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated with 30 days notice. Continued use of services constitutes acceptance of the modified Terms.
